Testimonial to Pat Randolph

Since I know that not all Property Profs also subscribe to the DIRT listserv (although you should), I wanted to share a post that Professor Roger Bernhardt from Golden Gate University posted to DIRT last night regarding the founder of DIRT, Professor Pat Randolph of University of Missouri at Kansas City.? Based on the flood of emails that DIRT has generated today, Pat Randolph has had an enormous impact on property professors and real estate lawyers across the country for many decades.? It is not often that we have the opportunity to thank someone for the contributions that they have made before they pass.? Like Roger, I wanted to share the information about Pat's condition so that if you have also been positively impacted by Pat, you have the opportunity to tell him so.

Although I do not know Pat Randolph well, I've seen him at least once a year, usually twice a year, throughout my career at meetings of the American Bar Association Real Property, Trust and Estate Law Section.? He has always been warm, funny, and kind to me.? As his constant presence at ABA meetings demonstrates, Pat worked hard to create and maintain connections between academia and the practicing bar.? The DIRT listserv is one example of those efforts (and again, you really should join).? He will be missed.

Here's the text of Rogert Bernhardt's post to DIRT:

Fellow Dirters: Many of you may not be aware of the fact that Pat Randolph, the founder and moderator of Dirt is terminally ill from cancer and will only be with us for a few more weeks.

????

It is not easy to adequately describe Pat's enormous contributions to legal education, real estate law and the legal community. Dirt arose as an offshoot of the ABA's Quarterly Development Report, which Pat assembled and provided to us for years, and it was the best way I knew of keeping up with developments outside my turf.? Later, when Pat got Dirt underway, it was the Daily Developments' fully briefed and thoughtfully analyzed cases that he provided for us almost every day of the year - that quickly became our bread and butter source of information.? I cannot estimate how much discipline and how many hours that Pat had to donate to keep Dirt vibrant for so many years.

Pat also sat on the Executive Committee of the Real Property Probate & Trust Section of the ABA, founded a Legal Education Section there, and pried loose a Real Estate Transactions Section out of the AALS Property Section. He was at the same time going around the country giving his "Top Ten" talks to numerous bar groups, as well as being an entertaining speaker at frequent panels for the ABA, ACMA, ACREL, and PLI.? On top of all that Pat wrote Friedman on Leases and played a pioneering role in starting a real estate legal system in China, constantly going back and forth there and accommodating their students in his house in Kansas City) and writing books and journals on it.

What I particularly valued most of Pat's many activities was his effort to bridge the gap between law school academics and the practicing real estate bar. Before Pat, property professors wanted nothing to do with real estate practice, and lawyers typically couldn't even remember the name of who taught the course to them in law school.? ?? Pat got the two groups interacting with each other, for which I am truly grateful.

Since Pat sadly may not be with us much longer, I wanted him to hear my sentiments while he is still able to appreciate them. I urge the rest of you who knew and are similarly grateful to Pat to go on Dirt and tell him your feelings. I believe that will please him.

Android for Kids: Kindle Fire, or a Nexus 7?

BrianKeith513 asks in our forums a pretty important question when it comes to purchasing a tablet for kids.

I'm asked a lot about mobile devices from friends and families, because I've worked in the mobile industry for many years now, in various capacities. However, I'm stumped over one thing; The Nexus 7 vs Kindle Fire for kids.

Now I know that the Nexus 7 is a better value, in that it is superior in just about every way than the Fire. The thing is, is the Kindle Fire easier to use for an elementary school-aged child? She uses my iPad 2, and loves it, but her mom wants her to have her own tablet, no more than $200. What do you think?

An excellent question. I've already weighed in on the Nexus 7 versus the Kindle Fire, and there's a clear winner. But that's for me. A (relatively) grown adult. I've got kids, and my kids use tablets. A lot, actually.

But here's the thing: My 6-year-old doesn't particularly care which tablet she uses. Hell, I'm not even sure she knows the difference. For her, it's all about the apps. Which does the tablet have Where's my Perry on it? Can she play Ski Safari? (Yes, I got her hooked on that, too.) How about PBS Kids or Netflix? So long as it has the apps that she uses -- and that she knows she's allowed to use -- hardware doesn't really matter to her. "I like them both the same, Daddy," she just said to me. Of course, she's 6, but a girl's allowed to have an opinion, amiright? And we're talking about bouncing between the Nexus 7, iPad 2 (and 3) and Samsung Galaxy Tab 10.1. This girl's 

Back to me, though, since I'm the one buying these things. If I had to choose between the Nexus 7 and the Kindle Fire for my budding little techie, I'd go with the Nexus 7, hands down. A few reasons for that:

• Better screen resolution: Hands down, that's a major factor.
• Ecosystem and flexibility: While I'm still amazed at how well the Amazon Appstore has done, there's nothing like the depth and flexibility of Google Play. Now, you have to balance the fact that Google has more apps with the fact that Amazon has better video. But Netflix takes care of a lot of that, and hopefully Google will one day catch up.

Now, make no mistake, my kids don't actually know all the minutiae when it comes to comparing the Kindle Fire to the Nexus 7. They know where the power button is. They know how to unlock the tablet. They know how to find their apps -- and there's a big difference, actually, since the Nexus 7 has proper homescreens with app icons -- and they know how to return to the homescreen. But, c'mon, they're 6 and 2. Tablets, at this point, are the same to them. At this point, the purchase needs to be about you, the parent. 

For me, those two reasons are enough to push me toward the Nexus 7 when it comes to my children. That might change when we see an updated Kindle Fire, so we'll have to revisit that.

Police seeking crash notification find 3 dead

VAN BUREN TOWNSHIP, Mich. (AP) ? Officers found a woman and her two young sons dead in their suburban Detroit home Thursday when they went there to notify the family of a fiery, fatal crash in Indiana.

Police in Wayne County's Van Buren Township said they went to the home after being notified of a man's death in a crash near Michigan City, Ind., which is just over the state line. They found a door ajar and, when no one responded, went into the home and found the three bodies in separate bedrooms.

Investigators didn't say how the three died but said the case was being investigated as homicide. The boys, ages 4 and 7, were found in beds, police said.

Police said they found a weapon in the home, but didn't indicate what kind. It was too early to speculate about what happened at the home, Police Capt. Gregory Laurain said. No notes were found in the home, he said, but police planned to search the burned remains of the vehicle in Indiana.

"There was no sign of forced entry. No sign of robbery," Laurain said.

Authorities went through the home about 25 miles west of Detroit, he said, collecting computers and voice messaging equipment. Laurain said the woman who was killed was described as a stay-at-home mother, while the man who died in the crash worked in information technology

Neighbors in the quiet, clean subdivision of Tudor- and Colonial-style homes declined to talk about the family.

Police in Indiana said earlier that two people died about 1:30 a.m. on Interstate 94 in a crash caused by a driver going the wrong way. Police said it appeared the driver left a highway rest area going eastbound in the westbound lanes and hit another vehicle head-on, causing a fire that engulfed both vehicles.

Both drivers were pronounced dead at the scene. Two westbound lanes of I-94 near Michigan City were closed for several hours after the crash.

Police say the circumstances of the crash remained under investigation. The names of those killed weren't immediately released.

Stocks rise on more signs of economic growth

NEW YORK (AP) ? Stocks are edging higher on Wall Street following more signs that the U.S. economic recovery is advancing, albeit at a slow pace.

The Dow Jones industrial average rose 15 points to 13,188 a half-hour after the opening bell Wednesday. The broader S&P 500 index rose two points to 1,406, while Nasdaq rose nine points to 3,025.

U.S. industrial production increased last month as factories made more cars, computers and airplanes, according to the Federal Reserve.

It was a sign that manufacturing is recovering after a weak spring. Also, consumer prices were unchanged in July from June, as a small drop in energy costs offset slightly higher food prices. The consumer price index hasn't changed since March, which means that inflation is in check.

Lower inflation gives the Federal Reserve more leeway to launch new programs intended to rekindle the economy. The Fed signaled at a meeting in late July that it is ready to act if growth and hiring stays weak.

Recent signs point to some economic improvement in July. Employers added the most jobs in five months, while consumers increased their retail spending after three months of declines.

Though they were better, the economic data showed a very weak recovery and that the U.S. economy is just trudging along.

It's left many investors wondering if the economy is fragile enough to create a sense of urgency among fiscal policy makers to act proactively. This slightly better outlook for the economy could prompt the Fed to hold off on taking action when its policy committee next meets in September.

In the last few weeks of the summer, trading volumes in the stock market have been low. Investors may also be holding off on taking aggressive positions ahead of a meeting of the U.S. Federal Reserve in Wyoming at the end of this month.

U.S. earnings were mixed.

Target rose 92 cents to $64.30 after the retailer increased its profit outlook for the year. Target is preparing its first expansion out of the U.S., into Canada.

Deere plummeted $5.11 to $75.02 after the agriculture machinery maker reported results that were well below Wall Street's expectations. The company attributed its poor results to a slowing global economy and the effects of a prolonged U.S. drought. Deere also cut its revenue forecast for the year.

Staples dropped $2 to $11.46 after the office and school supplies store said its income dropped 32 percent following weak sales in North America and Europe. The results fell short of analysts' expectations and the company cut its full-year earnings forecast.

Abercrombie & Fitch struggled to sell its preppy jeans and T-shirts in the previous quarter, but its results weren't as bad as analysts had forecast. The teen fashion leader also laid out plans for updating its fashions. The stock soared 10 percent, or $3.15, to $35.48.

Microsoft Surface for Windows RT tablet coming October 26th for $199?

We'll admit to being a little blown away when Microsoft launched the Surface -- it was an impressively polished tablet that we had heard barely a whisper of leading up to the mysterious launch event. But, there was one thing that we were still left wondering: how much would it cost? Now, with Acer getting all in a huff about competition and Microsoft conceding that some OEMs might be a little upset when this thing ships, we might just have an idea for you. According to an inside source, a session was held at Microsoft's recent TechReady15 conference in which all the launch details were laid out. If things go according to the plan detailed then, the Surface for Windows RT tablet will be launching October 26th -- no surprise there -- at a compelling price of $199.

That MSRP, almost certainly lower than Microsoft's own cost, would line it up against the Nexus 7 and even the Kindle Fire. It would put Windows 8 on the map in a big way and give a lot of people a lot of reason to try out an operating system that is going to feel rather different than previous incarnations. The question is: will it drive enough sales of media and apps for Microsoft to recoup its loss? Or, will companies like Acer put up enough of a fight in the months between now and October to keep Microsoft from undercutting its own partners? We'll find out soon, dear readers.
