Accused Sydney robber flees to Chinese consulate (AP)

SYDNEY ? Australian police have arrested a man accused of robbing a Sydney bar and then inadvertently fleeing to the grounds of the Chinese consulate, sparking a tense manhunt.

New South Wales Police Assistant Commissioner Mark Murdoch says police were chasing the man Friday when he scaled the fence surrounding the nearby consulate grounds. Murdoch says the man and police traded gunfire, but no one was hit.

Police shut down roads around the consulate and secured the complex before finding the man in a building outside the consulate grounds several hours later. He was arrested.

Police also arrested the man's alleged accomplice outside the bar. Officials did not release the men's names.

Murdoch says the man's decision to flee to the consulate grounds was random.

Italy 10-year borrowing costs stay near record at sale (Reuters)

MILAN (Reuters) ? Italy's borrowing costs fell from recent record highs at a bond auction on Thursday but cautious investors still demanded a near 7 percent yield to buy 10-year debt, a level seen unsustainable over time for the euro zone's third-largest economy.

Traders said the European Central Bank stepped in after the auction to buy Italian bonds on the open market as investors worry about the country's ability to sell enough long-term debt ahead of large redemptions early next year.

The ECB's injection of nearly half a trillion euros of cheap funding for banks and a new Italian budget package this month have eased pressure on short-term debt, but longer-dated bonds still pose a challenge.

Italy raised 7 billion euros ($9 billion) of debt in thin holiday markets, just above the mid-point of its target range.

It sold the top planned amount of its 10-year benchmark bond but the yield was 6.98 percent, not far from a euro lifetime record of 7.56 percent a month ago.

The yield on the three-year BTP bond fell more markedly to 5.62 percent from a euro era record of 7.89 percent at an end-November auction. At the time, in a sign of acute market worries about Italy's ability to repay, the three-year yield was higher than the one on the longer maturity.

"Today's decline in the auction yield by 'just' about 60 basis points versus end-November in such a high-yield territory underscores that the genuine pressure on Italy is still tremendous, despite bold ECB actions that have given (short-term

debt) a big boost," said David Schnautz, a rate strategist at Commerzbank in London.

The fall in the three-year yield came after Italian six-month borrowing costs halved at an auction on Wednesday.

These were the first Italian debt sales since the ECB flooded euro zone banks with three-year funds and the Rome government overcame internal opposition to a radical pension reform as part of Italy's third budget package since the summer.

This week's auctions will settle in January and help towards

the Treasury's challenging gross funding target of around 450 billion euros has for next year.

In a push to keep investors buying Italian debt, a new technocrat government in Rome is planning to tackle Italy's chronic low-growth problems.

But markets look with concern at some 91 billion euros of Italian bonds coming due between January and April.

"Given the scale of its funding requirements, there are still big concerns about Italy's ability to get through 2012," said Nicholas Spiro of Spiro Sovereign Strategy. "Next quarter is going to be all about Italy."

While Italy can count on strong domestic support such as from retail investors at its short-term debt sales, its longer-dated bonds are more reliant on foreign buyers, giving a clearer picture of the market attitude towards the country's debt.

The ECB intervened after the sale as Italian 10-year yields remained locked above 7 percent on the secondary market. ($1 = 0.7724 euros)

Por eso, en estas ?ltimas semanas, estuve trabajando en modernizar el proceso, eliminar todo lo que no fuera necesario, hacerlo m?s sencillo y documentarlo, de forma de que otros voluntarios puedan crear nuevas versiones de Wikipedias offline, quizas en otros idiomas, o con selecciones de grupos de p?ginas de temas espec?ficos, como historia, geograf?a o ciencias naturales.
Hay otros proyectos que tratan de hacer wikipedias offline, pero en general toman todo el contenido disponible. En nuestro caso, tenemos limitaciones de espacio, por lo que es importante tener un procedimiento de seleccion de p?ginas. En un pr?ximo post voy a escribir acerca de como funcionan estas herramientas.

Keeping up with your gamer gossip? Then you're probably up to snuff on the recent Ocean Marketing / Penny-Arcade spat. We held our tongues as the drama unfolded -- no easy task, considering Engadget's name was dragged into the affair -- but now it seems like the internet soap-opera is reaching its conclusion.

Not the gossiping type? Here's a quick recap: When N-Control's latest Avenger add-on missed its November 8th street date, customers with pre-orders were left wanting. Some reached out for answers, hoping they could still get their PS3 Avenger before Christmas. All they got in reply, though, were some *ahem* choice words from N-Control's third party marketing contractor, Paul Christoforo -- a man who gained instant notoriety when his emails caught the attention of Penny-Arcade's Mike Krahulik. Krahulik took exception to Christoforo's insults, threatening tone and name-drop posturing (that's where we came in) and responded by publishing the marketing mishap on his comic's website.

Suffice to say, it hasn't ended well for Paul Christoforo -- N-Control has released a statement saying that he and his marketing operation have been "categorically dismissed," stressing that Christoforo owns no stake whatsoever N-Control. After ejecting the elephant from the room, N-Control went on to announce that all PS3 Avenger pre-orders would be given a $10 discount, and penned in a new ship date for January 15th. "I created the Avenger to make people happy," said inventor and company founder Dave Kotkin, who originally designed the controller for a student who had a physical disability, "I deeply regret that so many people have any negative feelings toward it as a result of what has happened." N-Control seems bent on moving on -- which is fine by us, so long as they keep their customers better informed. Verizon backs down from convenience fee, values your two cents

The people (and government) have spoken and Verizon has listened -- and issued a press release. The carrier has officially backed off of the "single payment fee" that drew almost universal ire amongst subscribers and nabbed the attention of the FCC. Says Verizon Wireless CEO Dan Mead, "we believe the best path forward is to encourage customers to take advantage of the best and most efficient options, eliminating the need to institute the fee at this time." Looks like the company's gonna have to get a couple of bucks from you another way. No word yet on whether the FCC plans to investigate Sprint's similar long-standing fee. Preventive care: It's free, except when it's not

Bill Dunphy thought his colonoscopy would be free.

His insurance company told him it would be covered 100 percent, with no copayment from him and no charge against his deductible. The nation's 1-year-old health law requires most insurance plans to cover all costs for preventive care including colon cancer screening. So Dunphy had the procedure in April.

Then the bill arrived: $1,100.

Dunphy, a 61-year-old Phoenix small business owner, angrily paid it out of his own pocket because of what some prevention advocates call a loophole. His doctor removed two noncancerous polyps during the colonoscopy. So while Dunphy was sedated, his preventive screening turned into a diagnostic procedure. That allowed his insurance company to bill him.

Like many Americans, Dunphy has a high-deductible insurance plan. He hadn't spent his deductible yet. So, on top of his $400 monthly premium, he had to pay the bill.

"That's bait and switch," Dunphy said. "If it isn't fraud, it's immoral."

President Barack Obama's health overhaul encourages prevention by requiring most insurance plans to pay for preventive care. On the plus side, more than 22 million Medicare patients and many more Americans with private insurance have received one or more free covered preventive services this year. From cancer screenings to flu shots, many services no longer cost patients money.

But there are confusing exceptions. As Dunphy found out, colonoscopies can go from free to pricey while the patient is under anesthesia.

Breast cancer screenings can cause confusion too. In Florida, Tampa Bay-area small business owner Dawn Thomas, 50, went for a screening mammogram. But she was told by hospital staff that her mammogram would be a diagnostic test ? not preventive screening ? because a previous mammogram had found something suspicious. (It turned out to be nothing.)

Knowing that would cost her $700, and knowing her doctor had ordered a screening mammogram, Thomas stood her ground.

"Either I get a screening today or I'm putting my clothes back on and I'm leaving," she remembers telling the hospital staff. It worked. Her mammogram was counted as preventive and she got it for free.

"A lot of women ... are getting labeled with that diagnostic code and having to pay year after year for that," Thomas said. "It's a loophole so insurance companies don't have to pay for it."

For parents with several children, costs can pile up with unexpected copays for kids needing shots. Even when copays are inexpensive, they can blemish a patient-doctor relationship. Robin Brassner of Jersey City, N.J., expected her doctor visit to be free. All she wanted was a flu shot. But the doctor charged her a $20 copay.

"He said no one really comes in for just a flu shot. They inevitably mention another ailment, so he charges," Brassner said. As a new patient, she didn't want to start the relationship by complaining, but she left feeling irritated. "Next time, I'll be a little more assertive about it," she said.

How confused are doctors?

"Extremely," said Cheryl Gregg Fahrenholz, an Ohio consultant who works with physicians. It's common for doctors to deal with 200 different insurance plans. And some older plans are exempt.

Should insurance now pay for aspirin? Aspirin to prevent heart disease and stroke is one of the covered services for older patients. But it's unclear whether insurers are supposed to pay only for doctors to tell older patients about aspirin ? or whether they're supposed to pay for the aspirin itself, said Dr. Jason Spangler, chief medical officer for the nonpartisan Partnership for Prevention.

Stop-smoking interventions are also supposed to be free. "But what does that mean?" Spangler asked. "Does it mean counseling? Nicotine replacement therapy? What about drugs (that can help smokers quit) like Wellbutrin or Chantix? That hasn't been clearly laid out."

But the greatest source of confusion is colonoscopies, a test for the nation's second leading cancer killer. Doctors use a thin, flexible tube to scan the colon and they can remove precancerous growths called polyps at the same time. The test gets credit for lowering colorectal cancer rates. It's one of several colon cancer screening methods highly recommended for adults ages 50 to 75.

But when a doctor screens and treats at the same time, the patient could get a surprise bill.

"It erodes a trust relationship the patients may have had with their doctors," said Dr. Joel Brill of the American Gastroenterological Association. "We get blamed. And it's not our fault,"

Cindy Holtzman, an insurance agent in Marietta, Ga., is telling clients to check with their insurance plans before a colonoscopy so they know what to expect.

"You could wake up with a $2,000 bill because they find that little bitty polyp," Holtzman said.

Doctors and prevention advocates are asking Congress to revise the law to waive patient costs ? including Medicare copays, which can run up to $230 ? for a screening colonoscopy where polyps are removed. The American Gastroenterological Association and the American Cancer Society are pushing Congress fix the problem because of the confusion it's causing for patients and doctors.

At least one state is taking action. After complaints piled up in Oregon, insurance regulators now are working with doctors and insurers to make sure patients aren't getting surprise charges when polyps are removed.

Florida's consumer services office also reports complaints about colonoscopies and other preventive care. California insurance broker Bonnie Milani said she's lost count of the complaints she's had about bills clients have received for preventive services.

"'Confusion' is not the word I'd apply to the medical offices producing the bills," Milani said. "The word that comes to mind for me ain't nearly so nice."

When it's working as intended, the new health law encourages more patients to get preventive care. Dr. Yul Ejnes, a Rhode Island physician, said he's personally told patients with high deductible plans about the benefit. They weren't planning to schedule a colonoscopy until they heard it would be free, Ejnes said.

If too many patients get surprise bills, however, that advantage could be lost, said Stephen Finan of the American Cancer Society Cancer Action Network. He said it will take federal or state legislation to fix the colonoscopy loophole.

Dunphy, the Phoenix businessman, recalled how he felt when he got his colonoscopy bill, like something "underhanded" was going on.

"It's the intent of the law is to cover this stuff," Dunphy said. "It really made me angry."

Australia's pace attack produced a bowling display reminiscent of the side's era of dominance as they swept India aside to secure a 122-run victory in the first Test at the Melbourne Cricket Ground.

The performances of Ben Hilfenhaus, James Pattinson and Peter Siddle carried shades of Jason Gillespie, Brett Lee and Glenn McGrath in their pomp, as the tourists fell some way short of the 292 they had been set to win.

The quick trio bowled with tremendous accuracy throughout a devastating 47.5-over innings that spanned all three sessions on the fourth day, with Pattinson, who took four for 53, narrowly shading the honours.

But despite the 21-year-old rising star taking the most wickets, it was a collective effort that saw the Baggy Green across the finish line, with the three-pronged attack showing enough to suggest they can spearhead a bid to return to the top of the Test rankings - something that was taken for granted by Australians for almost a decade.

The tourists were always likely to be up against it chasing what was a fourth-highest MCG winning total, but their mindset could have been so different had they not allowed Pattinson and Hilfenhaus to take them on with the bat.

When Mike Hussey, who should have been given out when he edged Umesh Yadav behind, was snared by Zaheer Khan for 88, the margin was 249 but, 10 overs of improvised batting from the bowlers later, it was 43 runs greater.

Hilfenhaus fell to Ishant Sharma for 14 and then delivered with the ball in a nine-over spell before lunch, getting one to climb on Virender Sehwag who could only find Hussey in the gully.

India returned after lunch on 24 for one, but by the time they were back in the pavilion for tea, the score was 117 for six as Australia dominated a stunning middle session.

First an out-of-form Gautam Ghambir was tied in knots by Siddle - surviving twice in one over - before diverting an almost unplayable delivery from the same bowler into the hands of Ricky Ponting at second slip.

That brought Sachin Tendulkar to the crease - the master batsman still chasing an elusive 100th international ton - and even he showed signs of pressure as he narrowly avoided a run out from the arm of David Warner.

He had another elder statesman, Rahul Dravid, for company, but that did not last long as 'The Wall' misread one from Patterson and lost his middle stump for 10.

That quickly became 81 for six as Siddle, with the first ball of his second spell, got one to grow on Tendulkar who gave Hussey an easy catch in the gully.

Dhoni and R Ashwin then had a swinging session leading in to tea, but the latter fell just after it for 30, gloving a climber from Siddle (three for 42) to Cowan who had come in to short square leg.

Zaheer Khan decided to have some fun and clubbed Pattinson for six but paid with the very next ball, walking across his stumps to try and hit the 21-year-old out of the ground but only serving to fudge one to the ever-alert Cowan.

Dhoni (23) then lost his off stump to Pattinson as India fell apart at nine for 142 and, although Yadav had a late slog, he perished on 21 when he took on spinner Nathan Lyon and was caught out by a sprinting Warner on the boundary to wrap things up.

Yuan hits all-time high (Reuters)

SHANGHAI (Reuters) ? The yuan closed up against the dollar on Monday after hitting an all-time high in intraday trading, guided by a stronger mid-point by the People's Bank of China, and looks set for an over-4-percent appreciation for 2011, traders said.

The yuan is expected to remain stable or rise slightly in the last week of the year to close 2011 near 6.30 versus the dollar, in line with market expectations.

The currency is likely to continue to appreciate next year as China continues to post big trade surpluses despite a slowdown in exports and amid pressure from the United States to let the yuan rise to balance bilateral trade, traders said.

But the yuan's appreciation is likely to slow to around 3 percent in 2012, with much of the rise seen in the second half of next year as China may keep the yuan relatively stable in the first half to assess the impact of the euro zone crisis, they said.

"The PBOC has recently set a slew of strong mid-points and pumped dollars into the market via state banks, giving the market a clear signal that the government won't let the yuan depreciate," said a trader at a major Chinese bank in Shanghai.

"But the central bank appears not in a hurry to let the yuan appreciate amid global economic uncertainties resulting from the euro zone debt crisis. So the yuan is likely to move largely sideways in coming months."

Spot yuan closed at 6.3198 against the dollar, up from Friday's close of 6.3364, after hitting an all-time high of 6.3160. Its previous peak was 6.3294 hit on December 16.

The PBOC set the dollar/yuan mid-point at 6.3167 on Monday, stronger than Friday's 6.3209 and near the record-high fixing of 6.3165 on November 4.

FIGHTING SPECULATORS

The yuan has appreciated 4.27 percent so far this year, with most of the gain being recorded in the first 10 months of the year as China tries to rebalance trade and use the currency to help fight high inflation.

While the government has recently halted yuan appreciation amid slowing exports, it also seems to be wary of a weaker yuan that may lead to capital outflows.

Some overseas investors appear to have been shorting the yuan in recent months amid signs that China's growth is slowing under the double weight of a global slowdown and the country's monetary tightening policy in place since October last year.

The PBOC, in addition to using strong mid-points to signal government intentions to keep the yuan stable, has also acted to inject dollars into the market via state-owned banks whenever there are signs that the yuan is set to weaken sharply.

The yuan has thus been effectively kept in a range of 6.3 to 6.4 against the dollar since early November -- a trend traders say they believe to continue well into 2012.

In contrast, offshore benchmark one-year non-deliverable forwards (NDFs) have largely been forecasting a yuan depreciation in a year's time since late September, reversing a general trend of predicting an appreciation since the yuan's revaluation in July 2005.

One-year NDFs fell slightly to 6.3790 on Monday against 6.3810 at the close on Friday, implying that the yuan will depreciate 0.97 percent in 12 months from Modnay's PBOC mid-point, compared with a 1.01 percent fall implied on Friday.

Nate Boyer has made a lifetime's worth of surprising choices in the decade since he left Valley Christian High in Dublin: aspiring actor, working with autistic children in Los Angeles and refugees in Darfur, joining the Green Berets.

But none, perhaps, is more stunning than this one.

When Cal plays Texas in the Holiday Bowl on Wednesday, Boyer will be on the sidelines for the Longhorns -- a 30-year-old walk-on defensive back who never had played football before making the team.

Boyer probably won't play, but his mere presence -- and his personal story -- have inspired his teammates all season.

"Everybody knows Mr. Boyer," said Joe Bergeron, a 19-year-old freshman running back.

"He's got unique life experiences," said defensive backs coach Duane Akina. "When he can convey what it's like to be deployed and we're in (training camp) two-a-days, it shows there's no reason for us to be feeling sorry for ourselves."

Boyer, who grew up in Pleasanton picked Texas after he left the Green Berets. He went there largely because his GI Bill benefits covered his school costs.

Upon arriving in Austin, Boyer decided to try out for the football team even though, at 5-foot-11 and 190 pounds, "I was not a physical specimen."

Boyer never told the Texas coaching staff that he hadn't played football before. But he didn't fool Akina, the Longhorns' assistant head coach in addition to coaching the defensive backs. Akina

spotted Boyer as a newbie "the first time I saw him running around" he said, chuckling.

It didn't matter. Boyer outworked other candidates at a tryout last year, and made the cut.

"They threw me into the fire with a bunch of guys," Boyer said. "It's like trying out for the Special Forces. So much of it is mental toughness."

Although Boyer mostly stands on the sidelines during games -- his only appearance was on special teams -- Texas coach Mack Brown calls the reserve safety a valued member of the squad.

"He's a great young man," Brown said. "His character and determination are things we can all look up to. As he told (our players), you can't have a bad day when you're in the military."

Boyer didn't intend to become a role model. After graduating from Valley Christian, he flirted briefly with junior college, then followed his acting aspirations to Hollywood.

To make ends meet, he took a baby-sitting job that involved caring for an autistic child, and that led to doing therapy with autistic children in L.A.

"He's always had this thing about the injustice of the world, the unfairness," said his mother, Laura McDowell-Boyer.

After reading a magazine article about genocide in the Darfur region of Sudan, Boyer told his parents in 2004 he wanted to fly to Africa to work in the refugee camps. They gulped and gave him their blessing.

"I'd never been to a place like that," said Boyer, who worked in camps on the Chad side of the border. "It was mostly children and women. All their husbands were off fighting or had been killed."

The experience in Africa, coupled with the memory of the 9/11 attacks on New York, convinced Boyer to enlist in the Army. This was a tougher endeavor for his parents to embrace. Boyer's father, Steve, is a racehorse veterinarian and his mom is an environmental engineer. Both have Ph.D.s and expected their son would attend college.

Instead, he told them he planned to try out for the Special Forces unit after basic training.

Africa prepared Boyer for some of what greeted him in Iraq, but not all. In his first week, a bomb killed a fellow soldier.

"You're thinking, 'OK, this is real,'" he said.

He spent part of his time in Iraq training local military forces in the An Najaf province, earning him the Bronze Star.

By 2009, Boyer's active enlistment was up and he transitioned to the National Guard reserves. He also began looking at colleges.

Boyer is studying kinesiology at Texas and hopes to pursue an MBA. But spending time with his teammates is the best part of his day, he said.

Blake Gideon, a four-year starter for the Longhorns and Boyer's roommate, has worked with him from the start, helping him with football techniques that he knew nothing about.

"His military experience has shown in his willingness to learn and get better every day," Gideon said. "It didn't matter that he didn't play before. He's making up for that."

Boyer has three more years of football eligibility and is working to become a long-snapper for field goals and punts; it's another way to get on the field.

While an appearance in the Holiday Bowl is a long shot, Boyer had a day to remember Nov. 5 during a game against Texas Tech.

With is parents in the stands and the Longhorns were well on their way to a 55-20 victory, Boyer was sent in to help on kickoff coverage -- his first play in a college-football game.

Earlier in the game, Boyer was watching from the sidelines as Bergeron scored one of his three touchdowns.

"Everybody's cheering for him," Boyer recalled, "and he came right up to me, all pumped up. He looked me right in the eye and said, 'That one's for you.'"

Said Bergeron: "It was basically saying, 'Thank you,' and that I'm playing for him."

Lugar: Paul not in GOP mainstream

Texas Rep. and presidential candidate Ron Paul is out of line with the mainstream GOP when it comes to foreign policy, Sen. Dick Lugar (R-Ind.) says.

In an interview aired Sunday on CNN's "State of the Union," host Candy Crowley asked Lugar: "Is that a Republican party message?"

Replied the ranking member of the Senate Foreign Relations Committee, "That's one Republican's message." And he?went on to say that Paul's left-of-Obama foreign policy views were not representative of the party.

"No, of course not. ?And it's not a message which really a president of the United States could ever afford to extend. In other words, we're a -- a party and a -- a president of leadership, leadership in the world," he said. "We have a fleet that covers all the seas, that, as a matter of fact, makes foreign trade possible, trade of all sorts. ?We're the only country that can go everywhere all over the world, and, therefore, indispensable to our allies as well as to our own interests."

"These are very, very important parts of our national strength. And they involve foreign policy. They involve armed forces and a combination of these," Lugar said.

Hi,
I am in a quandary and need some advice. I want to upgrade my present Vista 32 bit Home Edition to the Windows 7 Home Edition 32 bit. I already conformed with the windows advisor that my system is ready for the Windows 7 upgrade, but I see that there are two options that I can purchase Windows 7 Home Edition and Windows 7 Home Edition N. Can you tell me the difference between the two and will it be beneficial for me to upgrade. I have had nothing but trouble trying to install Windows Office 2010 over the trial Windows Office 2007 recently and this is still not working properly despite contacting MS Store for advice. Why don't MS offer programs that can be directly downloaded from their site and will operate correctly after installation. I didn't know that a complete uninstall of Office 2007 was necessary before installing 2010 and I don't want a repeat performance in the change over to Windows 7. Any help would be much appreciated.

Ohio State's shock at NCAA penalties shows arrogance

E. Gordon Gee, the president of Ohio State, is disappointed but happy to finally have closure. Gene Smith, his athletic director, is also disappointed and surprised. Apparently the thought that the NCAA might actually ban his school from a bowl game next season never crossed his mind.

All of which illustrates two things very clearly: Almost every school that gets in trouble with the NCAA expects to get off with a wrist-slap because history shows the punishment is rarely more severe. And Ohio State was arrogant enough to believe the NCAA wouldn't dare mess with a program that has a license to print money every fall.

In the grand scheme of things, a one-year bowl ban and the loss of three scholarships a year for three years will do very little to Urban Meyer's plans for Big Ten (and no doubt world) domination. He'll still make $4 million in the coming year, and while the bowl ban might cost him a recruit or two this winter, he'll have high school stars banging on the locker room door inside the Horseshoe in short order.

Please don't cry for next year's Ohio State seniors. They will have been to three bowl games. When their president and athletic director refused to self-impose a bowl ban this season -- which would have cost the 6-6 Buckeyes an appearance in a Gator Bowl that will be watched by dozens -- they essentially dared the NCAA to ban them from the postseason in 2012.

"These players fought through a lot of adversity," Smith said in explaining to the Cleveland Plain Dealer why he didn't consider passing on a bowl game this year the way Miami did.

Ah, yes, all that adversity. Playing seven home games in front of 100,000 adoring fans was certainly tough. The non-conference wins over Akron, Toledo (barely) and Colorado were profiles in courage. The 3-5 record in the Big Ten was awe-inspiring.

Here's the bottom line: As Smith himself admitted, it never seriously occurred to him that the NCAA would actually, you know, punish the Buckeyes for former coach Jim Tressel's web of lies, his nearly year-long cover-up and his "resignation," which happened only after months of hemming and hawing. Remember Gee's comment in March when he was asked if he would consider firing Tressel? "Fire him? I just hope he doesn't fire me," Gee said.

Remember: Gee and Smith never pressured Tressel to tell them the truth about the investigation into OSU players getting free tattoos and other benefits from a booster who turned out to be under federal investigation.

They were the ones -- along with the frauds who run the Sugar Bowl -- who pleaded with the NCAA to let quarterback Terrelle Pryor and friends play in last January's game even though the players had violated NCAA rules. Hey, we've got a game to win here and we need some TV ratings! The heck with right or wrong. The NCAA played along with some nonsensical spin about playing in a bowl being a "unique experience."

A truly unique experience would be the NCAA striving for a standard higher than maximizing its own revenues.

Let's not get carried away with the fact that the NCAA imposed one real penalty on Ohio State. The loss of scholarships is meaningless. You don't think a college football program as powerful as Ohio State can't survive with 82 scholarship players for three years? If need be, they'll get around it. You can be sure that no player with serious potential will be told, "We don't have a scholarship for you" in Columbus any time soon.

If the NCAA ever wants to really get serious about punishing cheaters, it can't just knock them out of postseason for a year. It has to take them off television. For all the yammering about how USC paid for the Reggie Bush debacle, the Trojans were on TV just about every week the last two seasons, allowing coach Lane Kiffin to make sure recruits could see just how cool it is when that horse gallops around Los Angeles Coliseum whenever the Trojans score.

But there's too much money at stake to take a name-brand team off of TV. Imagine the screams coming from Bristol if Ohio State wasn't part of the Big Ten TV package for a year. Imagine how the folks at Black Rock would have reacted if Auburn had been banished from CBS in the wake of the Cam Newton investigation.

The NCAA's message remains essentially the same: Cheating pays. There is no better example than the meaningless three-game suspension Connecticut basketball coach Jim Calhoun received last February. Calhoun was allowed to coach his team to the national championship a few weeks later -- and then serve his "punishment" this season.

That may explain why Gee and Smith were so convinced they could take the Gator Bowl bid and then hand Meyer the keys to a brand-new program that could march straight to the Rose Bowl next season. Certainly the fact that the NCAA has allowed Ohio State to operate with two coaching staffs this month -- one preparing for the bowl; the other out recruiting -- would indicate that one of President Mark Emmert's goals is one day to dot the "I" at halftime inside Ohio Stadium.

Investigations continue at Miami, North Carolina and Oregon. One can only hope the penalties they face will be at least as severe as Ohio State's penalties. Oregon wasn't about to skip a chance to play in next month's Rose Bowl; it will take its chances when the time comes with the infractions committee. North Carolina opted to play in a meaningless bowl game while Miami did not. No doubt the leadership in Chapel Hill was thinking along the same lines as Gee and Smith.

Let's hope they're proven wrong too.

Dutch Parliament: Downloading Movies and Music Will Stay Legal

In an attempt to reduce widespread piracy in the Netherlands, the government there recently introduced a plan that would make downloading movies and music unlawful. However, this proposal was binned yesterday by a motion from the Dutch parliament due to concerns it would restrict the free flow of information, invade the privacy of citizens and invite copyright trolls. Instead, they encourage the entertainment industry to focus their attention on providing authorized alternatives.

amsterdamAs in many other countries around the world, downloading music and movies is hugely popular in the Netherlands. A massive 30% of the population is said to do so.

Presently, the Dutch see downloading movies and music for personal use as ?fair use? and not punishable by law. However, the current government is trying to find a solution to the ever-increasing piracy problem and has proposed a new bill to make it unlawful.

The topic has resulted in a heated political debate over the past several months, and yesterday opponents of the bill won the first battle as the Dutch parliament adopted a motion to keep downloading movies and music for personal use legal.

One of the main concerns of the parliament is that a download ban would go against the free and open Internet, as it restrict the free flow of information. The motion further states that enforcing such a ban via monitoring would invade the privacy of Internet users.

In addition, the parliament is worried that should downloading become unlawful, copyright holders will go after individual downloaders in court. This might result in a similar situation currently seen in countries like the United States and Germany, where hundreds of thousands of Internet subscribers are being sued by copyright trolls out to make a quick buck.

Instead of a download ban, the parliament suggests that the entertainment industry should focus more on offering authorized alternatives. At the moment, it is practically impossible to download high quality copies of recent movies and TV-shows via legal channels in the Netherlands.

The stance of the Dutch parliament is in line with an authoritative report commissioned by the government in 2009. In the report it was estimated that file-sharing has an overall positive effect on the Dutch economy. While it was recognized that the entertainment industry suffers some losses, these don?t outweigh the positive effects of file-sharing.

This report also motivated the Swiss government to keep downloading of music and movies totally legal a few weeks ago.

While the adopted motion is a win for the parties who want to keep downloading for personal use legal, State Secretary for Security and Justice Fred Teeven has already announced that he plans to bring the plan back in an altered form. Whether that will be able to address the current concerns of parliament is yet to be seen.

It's been a long December for RIM, and there's reason to believe this year won't be any better than the last. This month, the company was sued for its use of the BBX trademark and was forced to change its name to BlackBerry 10; then, it all hit the fan when co-CEO Mike Lazaridis broke the news that phones running the aforementioned OS won't arrive until late in 2012. And let's not even get started on the quarterly earnings report. Sadly, it's not over: BBM Canada, a Toronto-based broadcast industry group that has used the BBM moniker in one way or another for six decades, wants to reclaim its name -- used and made popular by RIM's BlackBerry Messenger service -- and has filed a lawsuit against the phone maker for trademark infringement. BBM Canada CEO Jim MacLeod says he's made several attempts to resolve the matter with them in hopes of avoiding the courtroom -- even to the extent of offering to rebrand his own company as long as RIM footed the bill -- to no success.

MacLeod told The Globe and Mail that "I find it kind of amazing that this wouldn't have been thought about before they decided to use the name -- the same thing goes for BBX." And according to court documents, it actually was: in February 2010, RIM attempted to apply for the BBM trademark with the Canadian Intellectual Property Office, was told that it wasn't registerable, and still went ahead and used it for its BlackBerry Messenger service anyway. We'll see what kind of explanation the company has for going ahead and using the three-letter acronym in a couple weeks, since a hearing has been scheduled for January 11th.

Update: RIM just sent us an email with an official statement regarding the matter:

Since its launch in July 2005, BlackBerry Messenger has become a tremendously popular social networking service. In 2010, RIM started to formally adopt the BBM acronym, which had, at that point, already been organically coined and widely used by BlackBerry Messenger customers as a natural abbreviation of the BlackBerry Messenger name. The services associated with RIM's BBM offering clearly do not overlap with BBM Canada's services and the two marks are therefore eligible to co-exist under Canadian trademark law. The two companies are in different industries and have never been competitors in any area. We believe that BBM Canada is attempting to obtain trademark protection for the BBM acronym that is well beyond the narrow range of the services it provides and well beyond the scope of rights afforded by Canadian trademark law. RIM has therefore asked the Court to dismiss the application and award costs to RIM. Further, for clarity, RIM's application to register BBM as a trademark with the Canadian Intellectual Property Office (CIPO) is pending and we are confident that a registration will eventually issue. The inference by BBM Canada that CIPO has refused RIM's BBM trademark application is quite frankly very misleading.

After lauding Steve Jobs as the "Michelangelo of our time," combining visionary genius with extraordinary engineering smarts, Google CEO Eric Schmidt suggested in an interview with the Italian daily Corriere della Sera that Google means to bring its own tablet to market in the next six months as good if not better than the iPad. Matt Barkley skips NFL Draft, returning to USC

Even with a projected Top 10 draft stock, USC quarterback Matt Barkley has decided to return for another season with the Trojans.

The junior from Newport Beach made his decision official on Thursday, making his announcement in the shadows of the USC greats in Heritage Hall.

"I am prepared to play quarterback in the NFL," Barkley explained. "It is my dream to play quarterback in the NFL. I intend to make that dream a reality.

"But I also know that I came to the University of Southern California to compete, and have a rare journey as a USC football player, to earn a degree from this exceptional university, and forge life-long bonds with the Trojan family.

"I will earn my degree, the bonds have been forged, but I know in my heart that I have not yet finished my journey as a Trojan football player. Our USC football team has been through some tough times, and we have persevered. The 2012 has some serious unfinished business to attend to, and I intend to play a part in it."

The crowd erupted, the band began playing, and the junior from Newport Beach flashed a smile as he confirmed what many USC fans had hoped.

Barkley threw for 3,528 yards, 39 touchdowns and just seven interceptions while completing 69.1 percent of his passes and leading the Trojans to a 10-2 record in 2011. He returns to Southern Cal with his two favorite receivers from the past season - Robert Woods and Marquise Lee - and will bring lofty expectations to the program for the first time since the Pete Carroll era.

Barkley was projected by many to be a Top 10 selection in the 2012 NFL Draft, but the lure of one more season as the Trojans starting quarterback was enough to bring him back to school. With the way USC finished the season in 2011, they will likely be early favorites to compete for a National Championship in 2012. ?Barkley grew up dreaming of playing for USC, and with the NCAA sanctions lifted he will get the opportunity to lead the Trojans to a Pac-12 title - or possibly more. ?

Ex-Notre Dame QB Crist transferring to Kansas (AP)

KANSAS CITY, Mo. ? Kansas coach Charlie Weis landed a pair of high-profile quarterbacks Thursday.

Former top recruit Dayne Crist announced on Twitter that he would join the Jayhawks for his senior season after a checkered career at Notre Dame, shortly before news broke that BYU quarterback Jake Heaps was also transferring to Kansas.

Crist will reunite with Weis, who recruited him to Notre Dame, and be eligible to play next season because he's already graduated from Notre Dame. Heaps will have to sit out under NCAA transfer rules but will have two seasons of eligibility remaining.

Officials at Kansas could not comment on the quarterbacks until they enroll.

Crist visited Kansas and Wisconsin before making his decision, which came the same day Badgers offensive coordinator Paul Chryst was hired as the head coach at Pittsburgh.

One of the country's top recruits out of Notre Dame High School in Sherman Oaks, Calif., Crist enrolled in South Bend in 2008 as part of a blockbuster recruiting class.

Things didn't pan out as anybody expected, though.

Weis struggled to win games despite suiting up numerous top prospects at Notre Dame, and was fired after the 2009 season. Crist had a season-ending knee injury his freshman year and another last year, after he completed 60 percent of his passes for 2,033 yards with 15 touchdowns and seven interceptions under Weis' replacement, Brian Kelly.

He came back from the injury to regain the starting job this season, but was benched at halftime of the opener against South Florida. Crist played only a handful of snaps behind Tommy Rees the rest of the way, ultimately announcing that he had decided to transfer.

"After a long & difficult decision making process, I'm incredibly excited to join the Kansas football team. Rock Chalk Jayhawk!" Crist wrote on Twitter.

He'll compete for the starting job at Kansas right away.

Sophomore quarterback Jordan Webb struggled with consistency last season, completing 63 percent of his passes for 1,884 yards with 13 touchdowns and 12 interceptions during a 2-10 season.

Webb was benched a few times in favor of senior Quinn Mecham, who fared little better.

Although he will only have one season of eligibility, Crist represents a major coup for Weis, who needs a strong-armed quarterback to effectively run his pro-style offense. Crist was the No. 2-ranked pro-style quarterback in the nation out of high school, according to Rivals.com, behind only Blaine Gabbert, who is now the starter for the Jacksonville Jaguars.

Heaps was just as highly touted as Crist coming out of Sammamish (Wash.) Skyline High School. He was rated by Rivals.com as the No. 1 pro-style quarterback in the class of 2010.

Heaps graduated early so that he could enroll at BYU, and started the final 10 games his first season, setting freshman school records for yards passing (2,316), attempts (383), completions (219), touchdown passes (15). The Cougars finished 7-6 and beat UTEP in the New Mexico Bowl.

He struggled early this season, though, and lost the starting job to Riley Nelson. Heaps asked BYU coach Bronco Mendenhall to be released from his scholarship earlier this month.

First Earth-sized planets spotted

Astronomers have detected the first Earth-sized planets, which are orbiting a star similar to our own Sun.

In the distant past they may have been able to support life and one of them may have had conditions similar to our own planet - a so-called Earth-twin - according to the research team.

They have described their findings as the most important planets ever discovered outside our Solar System.

Details of the discovery are outlined in Nature journal.

Dr Francois Fressin, of the Harvard-Smithsonian Centre for Astrophysics in Cambridge, US, who led the research, said that the discovery was the beginning of a "new era" of discovery of many more planets similar to our own.

Both planets are now thought to be too hot to be capable of supporting life.

But according to Dr Fressin, the planets were once further from their star and cool enough for liquid water to exist on their surface, which is a necessary condition for life.

"We know that these two planets may have migrated closer to their Sun," he told BBC News. "(The larger of the two) might have been an Earth twin in the past. It has the same size as Earth and in the past it could have had the same temperature".

Rock and a hard place

One of the planets, named Kepler 20f, is almost exactly the size of the Earth. Kepler 20e is slightly smaller at 0.87 times the radius of Earth and is closer to its star than 20f.

They are both much closer to their star than the Earth is to the Sun and so they complete an orbit much more quickly: 20e circles its star in just six days, 20f completes an orbit in 20 days whereas the Earth takes a year.

The researchers say that these planets are rocky and similar in composition to our own planet.

Dr Fressin says that the planets' composition may be similar to Earth's with a third of it consisting of iron core. The remainder probably consists of a silicate mantle. He also believes that the outer planet (Kepler 20f) may have developed a thick, water vapour atmosphere.

The discovery is important because it is the first confirmation that planets the size of Earth and smaller exist outside our Solar System. It also shows that the Kepler Space Telescope is capable of detecting relatively small planets around stars that are thousands of light-years away.

The telescope has discovered 35 planets so far. Apart from 20e and f, they have all been larger than the Earth.

Up until now, the most significant discovery, also by a group including Dr Fressin, was of a planet nearly two-and-a-half times the size of Earth that lay in the so-called "Goldilocks zone". This is the region around a star where it is neither too hot, nor too cold, but just right for liquid water and therefore life to exist on the planet.

But Dr Fressin believes that the two new planets are a much more important discovery.

The telescope is scanning 150,000 stars and Professor Andrew Coates of the Mullard Space Science Laboratory in Surrey believes that they will soon find a planet the size of Earth in the Goldilocks Zone.

"With every new discovery we're getting closer to the 'holy grail' of an Earth-like planet around a Sun-like star," he said.

NASA's RXTE detects 'heartbeat' of smallest black hole candidate

An international team of astronomers has identified a candidate for the smallest-known black hole using data from NASA's Rossi X-ray Timing Explorer (RXTE). The evidence comes from a specific type of X-ray pattern, nicknamed a "heartbeat" because of its resemblance to an electrocardiogram. The pattern until now has been recorded in only one other black hole system.

Named IGR J17091-3624 after the astronomical coordinates of its sky position, the binary system combines a normal star with a black hole that may weigh less than three times the sun's mass. That is near the theoretical mass boundary where black holes become possible.

Gas from the normal star streams toward the black hole and forms a disk around it. Friction within the disk heats the gas to millions of degrees, which is hot enough to emit X-rays. Cyclical variations in the intensity of the X-rays observed reflect processes taking place within the gas disk. Scientists think that the most rapid changes occur near the black hole's event horizon, the point beyond which nothing, not even light, can escape.

Astronomers first became aware of the binary system during an outburst in 2003. Archival data from various space missions show it becomes active every few years. Its most recent outburst started in February and is ongoing. The system is located in the direction of the constellation Scorpius, but its distance is not well established. It could be as close as 16,000 light-years or more than 65,000 light-years away.

The record-holder for wide-ranging X-ray variability is another black hole binary system named GRS 1915+105. This system is unique in displaying more than a dozen highly structured patterns, typically lasting between seconds and hours.

"We think that most of these patterns represent cycles of accumulation and ejection in an unstable disk, and we now see seven of them in IGR J17091," said Tomaso Belloni at Brera Observatory in Merate, Italy. "Identifying these signatures in a second black hole system is very exciting."

In GRS 1915, strong magnetic fields near the black hole's event horizon eject some of the gas into dual, oppositely directed jets that blast outward at about 98 percent the speed of light. The peak of its heartbeat emission corresponds to the emergence of the jet.

Changes in the X-ray spectrum observed by RXTE during each beat reveal that the innermost region of the disk emits enough radiation to push back the gas, creating a strong outward wind that stops the inward flow, briefly starving the black hole and shutting down the jet. This corresponds to the faintest emission. Eventually, the inner disk gets so bright and hot it essentially disintegrates and plunges toward the black hole, re-establishing the jet and beginning the cycle anew. This entire process happens in as little as 40 seconds.

While there is no direct evidence IGR J17091 possesses a particle jet, its heartbeat signature suggests that similar processes are at work. Researchers say that this system's heartbeat emission can be 20 times fainter than GRS 1915 and can cycle some eight times faster, in as little as five seconds.

Astronomers estimate that GRS 1915 is about 14 times the sun's mass, placing it among the most-massive-known black holes that have formed because of the collapse of a single star. The research team analyzed six months of RXTE observations to compare the two systems, concluding that IGR J17091 must possess a minuscule black hole.

"Just as the heart rate of a mouse is faster than an elephant's, the heartbeat signals from these black holes scale according to their masses," said Diego Altamirano, an astrophysicist at the University of Amsterdam in The Netherlands and lead author of a paper describing the findings in the Nov. 4 issue of The Astrophysical Journal Letters.

The researchers say this analysis is just the start of a larger program to compare both of these black holes in detail using data from RXTE, NASA's Swift satellite and the European XMM-Newton observatory.

"Until this study, GRS 1915 was essentially a one-off, and there's only so much we can understand from a single example," said Tod Strohmayer, the project scientist for RXTE at NASA's Goddard Space Flight Center in Greenbelt, Md. "Now, with a second system exhibiting similar types of variability, we really can begin to test how well we understand what happens at the brink of a black hole."

Launched in late 1995, RXTE is second only to Hubble as the longest serving of NASA's operating astrophysics missions. RXTE provides a unique observing window into the extreme environments of neutron stars and black holes.
